The 'pay-off'

In my 06.04.05 letter to Michael Howard, then Leader of the Conservative Party, I wrote:

"It fills me with utter disbelief to see what 'the system' is prepared to do to help a rogue landlord build a penthouse flat at the cost of lessees and further increase his financial gains by getting flats cheaply as a result of extortionate service charges.

At the end of the day, this is the essence of it"

This was in April 2005. The following is what happened subsequently.

In parts of the site I have captured this slide which includes my estimate (in Mar 06) of the total 'potential pay-off' of £7million (US$12.3m)

The biggest part of the 'jackpot' was the sale of the lease on the penthouse apartment BGL 54 458...that was

"categorically NOT going to be built",

"because it was not a viable proposition"...

...and associated car parking space, title BGL 47 667 - on 1 Dec 05 - by "Steel Services Ltd" and "Sloan Development"

(both were on the 27.02.07 - fraudulent - claim filed against me in Her Majesty's West London County Court - Overview # 3 ; Portner and Jaskel # 6).

The transaction is recorded at £3.9 million (US$6.9m).

The penthouse was then advertised In Oct 07 for £6,500,000 (US$11.5m).

 

How was this money made?

 

In my non-lawyer opinion - by stealing c. £500,000 (US$882,000) from Jefferson House's leaseholders:

 

(1)- Through deceit

Firstly, OF KEY IMPORTANCE, note...

...the 21.12.01 letter, addressed to "Dear Flat Owner", from Joan Hathaway, MRICS, Martin Russell Jones (MRJ), 'managing' agents for Jefferson House:

"We have to state that the sum quoted may be exceeded due to disbursements but these will be of a minor nature.

Sufficient funds are held to cover the cost of the works within the Reserve Fund"

...that was followed 6 months later by a 15.07.02 demand for £736,200 (US$1.3m) (Overview # 1).

The construction of the penthouse apartment started in Oct 04 - See Photo gallery ; Planning applications.

As can be seen from the overview on the 'Major works' page, the intention to build the penthouse was repeatedly denied by Andrew David Ladsky's gang of racketeering puppets: Joan Hathaway, MRICS, and Barrie Martin, FRICS, of the then MRJ, and Brian Gale, MRICS.

Gale and Mansell Construction Services continued with the lie at the time the works started, by claiming, in their (04.11.xx)" Description of the works" that what they were doing was:

"Replacing asphalt roof".

(A claim Gale had first made in 'his' 02.02.xx so-called 'condition survey').

Both, Brian Gale and Martin Russell Jones continued to lie once the works were completed in early 2006 - see 'Major works- snapshots of some of the correspondence.

As to the accountants, Pridie Brewster, it claimed to be:

"unaware of the London Leasehold Valuation Tribunal findings at the time that we were preparing our certificate" (Brewster # 3)

...findings that had the effect of reducing the sum demanded by £500,000 (US$882,000) - a reduction of 70% (LVT # 4 ; Overview # 2)...

... - but nonetheless took NO action (breach Theft Act s.17 False accounting).

In fact, with its 'regulator', the Institute of Chartered Accountants in England and Wales (ICAEW), they came up with the absolutely outrageous excuse (in the 29.08.06 letter (that returned the verdict of "no malpractice"):

"tenants could willingly contribute towards the extra costs should they wish to do so" (summary of my complaint # 6.1)

 

My reply to that: if the tenants were that "willing to contribute": how come they ended-up on the 29 Nov 02 claim?

How do answer that one Pridie Brewster and ICAEW?

 

(2)- By breaching leaseholders' statutory rights

Andrew David Ladsky, being 'unhappy' with the fact that:

  • ...- his 07.08.02 application to the tribunal had not gone his way (LVT # 4);

...(3) on the day, in Aug 04, that closure was obtained against the last valiant leaseholder (WLCC # 14, Wandsworth County Court # 2), (and 2 years after the original demand of July 02)...

... - Ladsky asked Barrie Martin, FRICS, to announce, in a 02.08.04 letter to "ALL Lessees", the appointment of a new contractor, Mansell Construction Services - without going through the legally required consultation procedures (Overview # 5).

There are many, many more examples in Andrew David Ladsky's books, those of his gang of racketeers (see e.g. Extortion), as well as henchmen in the wider supporting infrastructure to the residential leasehold sector - that they perceive the law of the land as: 'there to be ignored'.

(See definition of 'crime - criminal', which includes links to various statutes, supported by examples of breaches of these Acts by various parties - the breach of which amounts to committing criminal offences) - because there is no fear of sanction - as the State is a key participant.

Further, there are 'ways and means' of 'dealing' with 'the little people' who 'dare' oppose 'Establishment'-controlled organized crime activities: fraud, etc. - that come under the banner of 'retribution' - using the key tool: mental torture - which includes all forms of persecution.

 

The following are details on an estate agents website at 9 Jan 07

The person was one of the leaseholders who wrote to the tribunal (LVT # 1.4 ; Other Residents))

Prior 'applicants' for planning applications in relation to the lightwell include CMD Ltd on 25.11.02 ; 'Steel Services' on 07.01.04 and on 19.04.04)
